Welcome to Captain Speaking, the aviation communication app created by Mykyta Karpyshyn ("Developer" or "we" or "us"). Before you begin using the Captain Speaking app ("App"), we kindly request you to carefully read and understand the following Terms of Use ("Terms"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the App.
By accessing or using the Captain Speaking App, you acknowledge that you have read, understood, and accepted these Terms. These Terms constitute a legally binding agreement between you and the Developer.
The Captain Speaking App offers two main features:
The Captain Speaking App is free to use until the user completes the first 8 quizzes. After that, users will be asked to purchase a monthly subscription to continue using the App's premium features. The subscription pricing will be clearly displayed within the App, and users will have the option to accept or decline the subscription offer.
The Captain Speaking App does not require any user registration, and it does not collect any personal data from users. We are committed to protecting your privacy, and our data collection and usage practices are governed by our Privacy Policy.
To improve the App's performance and user experience, the Captain Speaking App uses Google Analytics and Firebase. These analytics tools collect anonymous data, such as device information, usage patterns, and user interactions within the App. The data collected is used solely for analytical purposes and to enhance the App's functionality.
While using the Captain Speaking App, you may have the opportunity to submit feedback, comments, or other materials ("User Content"). By submitting User Content, you grant the Developer a worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.
The Captain Speaking App and all its original content, including the curated audio chunks of real aviation communication with subtitles ("Content"), are the property of the Developer. The real ATC communications used in the App have been sourced from publicly available materials. While the Developer holds the rights to the arrangement and presentation of the Content, it is essential to acknowledge that the underlying ATC communications remain the intellectual property of the respective original sources.
Users of the Captain Speaking App are granted a limited, non-exclusive, and non-transferable license to access and use the Content solely for personal, non-commercial purposes related to aviation education and training.
Users must not reproduce, distribute, modify, or create derivative works from the original ATC communications or the App's Content without obtaining express written permission from the respective original sources and the Developer.
The use of real ATC communications in the App is for educational and entertainment purposes only. It is not intended to infringe upon the rights of the original sources or claim ownership of their intellectual property. If you believe that your rights have been violated, please contact us at techops.captain.speaking@gmail.com, and we will promptly address your concerns.
THE CAPTAIN SPEAKING APP IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OR REPRESENTATIONS, WHETHER EXPRESS OR IMPLIED. THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
UNDER NO CIRCUMSTANCES SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE CAPTAIN SPEAKING APP, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
These Terms shall be governed by and construed in accordance with the laws of Republic of Poland. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Republic of Poland.
